CONDITIONS OF PARTICIPATION & DATA PROTECTION INFORMATION

The organizer of the ZEISS Facebook competition is Carl Zeiss AG, Carl-Zeiss-Straße 22, 73447 Oberkochen, Germany (hereinafter referred to as the ‘Organizer’).

Participation in the Competition is exclusively subject to the following terms and conditions. By participating in this competition, the participant accepts these conditions of participation.

CONDITIONS OF PARTICIPATION

1. Prize

A prize draw will be held among all eligible participants:

1x a ‘ZEISS Merchandise Package’ consisting of 1x YETI x ZEISS tumbler, 1x ZEISS water bottle, 1x ZEISS Tote bag, 1x ZEISS notebook, 1x ZEISS keyring, 1x ZEISS mints, and 1x ZEISS pen & notepad.

2. Participation

2.1 The competition begins on 01.10.2024 at 07:00am (bst) and ends on 29.10.2024 at 11:59am (bst) (hereinafter: competition period). Participation is only possible during the competition period.

2.2 Participants must have a Facebook account.

2.3 All persons of legal age who follow the ZEISS Hunting channel on Facebook and ‘like’ the competition post are eligible to participate. (MUST be 18+ to participate).

2.4 To Participate in competition and be entered into the competition must be following the ZEISS Hunting Facebook page, ‘like’ and ‘share to feed’ the competition post and tag a hunting apparel brand in the comments.

2.5 Participation is free of charge. Participation and the chances of winning are not dependent on the purchase of products.

3. Excluded Persons

3.1 Each participant may enter the competition once. The use of multiple Facebook profiles to increase the chances of winning (‘multiple entries’) is not permitted and will result in exclusion from the competition.

3.2 Employees of the Organizers and persons involved in the implementation of the competition, as well as their family members, are excluded from participation.

3.3 The Organizers reserves the right to exclude participants from the competition for good cause, in particular in the event of a breach of the conditions of participation, suspected manipulation and/or false or misleading information.

4. Prize Processing

4.1 The prize will be processed by the organizer. The winner will be drawn at random from all participants on 30.10.2024 10:00am (bst). In the event of a win, the winner will be informed of the prize via a direct message after the draw and asked to send his/her email address via a Facebook direct message or by email to zeissadvocacy@ostdigital.co.uk in order to coordinate further processing. The winner is responsible for the accuracy of the contact details provided.

4.2 If the winner cannot be contacted by direct message, does not respond within 7 days of the prize notification being sent and/or the prize cannot be sent to the winner, the claim to the prize will be forfeited. The organizer reserves the right to draw a new winner.

4.3 In the event of a win, participants agree that their Facebook account will be mentioned on the ZEISS Hunting channel as part of the competition.

5. Liability

5.1 The Organizer is not liable for material or legal defects in the prize and/or defects that are or may be related to the prize.

5.2 Participants’ claims for damages are excluded. Excluded from this are claims for damages by participants arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by the organizer, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract.

5.3 In the event of a breach of material contractual obligations, the Organizer shall only be liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless it concerns claims for damages by participants arising from injury to life, limb or health.

5.4 These limitations of liability shall not apply if the Organizer has fraudulently concealed the defect or has assumed a guarantee for the quality of the item. The provisions of the Product Liability Act remain unaffected.

6. Miscellaneous

6.1 Cash payment of the prize is excluded, as is participation via gambling clubs and automated services. The prize entitlement is neither transferable nor exchangeable.

6.2 The Organizer reserves the right to interrupt or prematurely terminate the competition at any time without prior notice and to adjust the conditions of participation. In particular, the Organizer is entitled to do so if the proper execution of the competition can no longer be guaranteed for technical, legal or economic reasons and/or does not appear reasonable.

6.3 The competition is subject to the law of the Federal Republic of Germany. Legal recourse is excluded regarding the organization of the competition, the decision to award the prize and the awarding of the prize.

7. Disclaimer

This competition is in no way connected to Facebook and is in no way sponsored, supported or organized by Facebook. Facebook is not responsible for any of the content published as part of the competition. Participants indemnify Facebook against claims by third parties in connection with this competition.

3. Data Collected during Use, Purpose and Legal Basis

It is necessary to process the following data in order to carry out the competition: Facebook account name and, for the winner, additionally the e-mail address, telephone number and address data. This will determine and contact the winner, send the prize and announce the winner on the Facebook account of ZEISS Hunting. The processing of the above-mentioned personal data is based on the fulfilment of the contract between you and us (Art. 6 para. 1 lit. b GDPR).

4. Storage Period

The personal data collected will be deleted as soon as it is no longer required for its intended purpose and all statutory retention periods have expired.

5. Data Processing outside the EEA

If data is transferred to service providers or other third parties outside the EEA, suitable protection instruments are established to ensure the security of the transfer. This is covered by adequacy decisions of the EU Commission (Art. 45 para. 3 GDPR) in the case of data transfers to countries. For all other third countries, contracts have been concluded in accordance with Commission Implementing Decision (EU) 2021/914 of 4 June 2021 on standard contractual clauses for the transfer of personal data to third countries pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council. Personal data will be passed on to third parties to enable the competition to be organised. Personal data passed on may only be used by the third parties for the stated purposes.

Right to information, rectification, erasure, restriction of processing, to data portability. You also have the right to object to processing based on Art. 6 para. 1 f) GDPR in accordance with Art. 13 para. 2 b) in conjunction with Art. 21 GDPR.
